We comply with the Australian Consumer Law (ACL), providing guarantees to ensure the quality and suitability of our products and services. These Terms are designed to align with your rights as a consumer under the ACL.

1A. Definitions
For the purposes of these Terms:

  • Living Oceans Aquarium means the complete all inclusive aquarium sold by Living Oceans, including livestock and accessories, available in 80L, 130L, and 200L sizes.

  • Livestock means fish, corals, invertebrates and Living Sand supplied by Living Oceans.

  • Care Guidelines means the care and maintenance guidance provided through the Membership Portal and training materials, as updated by Living Oceans.

  • Membership Portal means the online platform where customers access consultations, training, support, and exclusive member products and services.

  • Two-Step Delivery means the staged delivery process for the Smart Ecosystem Aquarium, where aquarium equipment is delivered first, followed by livestock once setup has been confirmed and the customer’s checklist has been returned.

2. Product Information

We provide detailed descriptions of all products offered for sale through our website, including the Smart Ecosystem Aquarium and its components. By purchasing from our site, you acknowledge and agree to the following terms regarding product information:

2.1 Product Description

The Living Oceans Aquarium is a complete all inclusive marine aquarium bundle available in 80L, 130L, or 200L sizes. Each bundle includes:

  • Aquarium (80L: 45 × 45 × 40 cm, 130L: 60 × 50 × 45 cm, 200L specifications provided in the product manual)
  • Aquarium Cabinet (white or black)
  • Autonomous systems for lighting, heating, feeding, filtration, and water top-up
  • Living Blocks reef 
  • Dry Sand
  • Algae Refuge
  • Livestock: Standard Clownfish (3x 80L Aquarium, 4x 130L/200L SEA Aquarium), 
    5-Coral Pack, Living Sand and Biomedia
  • Accessories for cleaning and system management
  • Maintenance kit
  • Access to mandatory online training resources

2.2 Customisation Options

Customers may choose to upgrade their standard fish to designer varieties or purchase additional corals during the complimentary online consultation following their aquarium purchase.
All upgrades and add-ons are invoiced separately and must be paid in full prior to scheduling livestock delivery.

2.3 Natural Variations

Living Blocks, Living Sand, and livestock are natural or handcrafted items and may vary in appearance and form. Images and descriptions on the website are illustrative only.

2.4 Pre-Orders

Products marked as pre-order, including those with expected shipping dates, require full or partial payment at checkout. Pre-orders are subject to availability and may experience unforeseen delays. We will communicate any changes to estimated shipping times.

2.5 Member-Exclusive Products

Certain products, including additional livestock, coral packs, and specialty supplies, are available exclusively to members of our Membership Portal. Non-members will not have access to purchase these items.

2.6 Mandatory Training

All customers are required to complete the mandatory online training modules provided via our Membership Portal before delivery or installation of Living Oceans Aquarium. These modules are designed to ensure customers understand the basic care and maintenance requirements of their aquarium and livestock. Delivery will only be scheduled upon successful completion of the training. Failure to complete the training may result in delays.

2.7 Delivery and Installation

The Living Oceans Aquarium is delivered using a two-step delivery process to allow time for proper setup, ensuring your aquarium is fully prepared and safe for livestock.

Step 1 – Equipment Delivery

All aquarium equipment is dispatched first via road courier. This includes the aquarium, cabinet, accessories, Maintenance Kit, and dry sand.

Step 2 – Livestock Delivery

The Living Oceans Aquarium is delivered using a two-step delivery process designed to ensure safe setup and livestock health.

Customers may self-install using the provided Maintenance Kit and online tutorials or choose professional setup at checkout.

2.8 Educational and Maintenance Support

Every Living Oceans Aquarium purchase includes access to educational resources and care instructions via the Support Hub. Customers are responsible for following the Care Guidelines provided to support the performance and health of their Smart Ecosystem Aquarium.

2.9 Accuracy of Information

We endeavour to ensure that all product descriptions, images, and pricing details on our website are accurate. However, typographical errors or inaccuracies may occur, and we reserve the right to correct them without prior notice.

2.10 Post-Purchase Online Consultation

After purchasing a Living Oceans Aquarium, customers may choose to book a complimentary online consultation with a Living Oceans marine scientist to personalise and upgrade their livestock selection. This consultation may include:

• Upgrading standard fish selections to designer varieties
• Selecting additional corals
• Selecting additional fish and clean-up crew livestock
• Purchasing optional services

Any additional livestock, upgrades, products, or services selected during the consultation will be invoiced separately and must be paid in full prior to delivery.

3. Pricing and Payment

We provide transparent pricing and flexible payment options for all products and services. By purchasing from our website, you agree to the following terms regarding pricing and payment.

3.1 Currency and Taxes

  • All prices are listed in Australian Dollars (AUD) and include Goods and Services Tax (GST), unless otherwise specified.

  • Any additional fees, such as shipping or handling, will be clearly displayed at checkout.

3.2 Payment Methods

  • We accept payments via major credit and debit cards, PayPal, and other methods listed on our website.

  • Payment details are securely processed through trusted third-party payment providers. We do not store credit card information.

3.3 Pre-Orders

  • Pre-orders may require partial or full payment at the time of checkout. The balance must be paid prior to delivery, as specified in the pre-order terms provided at the time of purchase.

  • Estimated Delivery Dates: Estimated shipping dates for pre-ordered items will be provided at the time of purchase, but these dates are subject to change due to unforeseen circumstances. Customers will be notified of any changes.

3.4 Deposits and Payment Plans

  • For eligible purchases, we may offer payment plans or accept deposits at checkout. Details of payment plan terms, including interest rates and installment schedules, will be provided at the time of selection.

  • Failure to meet installment deadlines may result in order cancellation and forfeiture of the deposit.

3.5 Price Changes

  • Prices are subject to change without prior notice; however, confirmed orders will not be affected by subsequent price changes.

  • Any promotional pricing or discounts are valid only during the promotional period and cannot be retroactively applied to previous purchases.

3.6 Non-Payment

  • Orders will not be processed or shipped until full payment (or applicable installments for payment plans) has been received.

  • In cases of non-payment or chargeback disputes, we reserve the right to cancel the order and restrict future purchases.

3.7 Billing Accuracy

  • Customers agree to provide accurate and complete billing and account information at the time of purchase.

  • It is the customer’s responsibility to promptly update any changes to their billing address, contact details, or payment information.

3.8 Refunds and Adjustments

  • Refunds for eligible orders are governed by our Refund Policy. Customers are encouraged to review the Refund Policy for detailed terms.

  • Any adjustments or price corrections due to errors in billing will be promptly communicated.

3.9 Post-purchase Adds-on

  • Additional items or services selected during the post-purchase consultation are invoiced separately. These may include upgraded fish, extra coral packs, or subscription services. Full payment must be received before delivery and installation can be confirmed.

4. Delivery and Installation

This section outlines the process, requirements, and responsibilities associated with the delivery and installation of the Smart Ecosystem Aquarium (S.E.A.) and related products.

4.1 Two-Step Delivery

Living Oceans provides a two-step delivery process to allow adequate time for setup and ensure the aquarium is safe and stable before livestock is introduced.

Step 1 – Equipment Delivery
All aquarium equipment is dispatched first via road courier. This includes the glass aquarium, cabinet, accessories, Maintenance Kit, and dry sand. Equipment is shipped in multiple boxes to protect components during transport.

Step 2 – Livestock Delivery
Once the aquarium setup has been completed and the customer’s setup checklist has been signed and returned, livestock is dispatched via express courier.
This staged process allows for proper system preparation and safeguards livestock health during transit and acclimation.

4.2 Delivery Fees by Region

4.3 Delivery Scheduling

Equipment delivery is scheduled following order confirmation and payment clearance, subject to courier capacity and stock availability.

Livestock delivery will only be scheduled once the customer has:

• Completed the mandatory training modules
• Completed the aquarium setup in accordance with Living Oceans guidelines
• Returned the required setup checklist

Delivery and installation scheduling may vary depending on regional courier capacity and team availability. Living Oceans will communicate any significant delays or scheduling changes promptly.

4.4 Self-Installation

Each Living Oceans Aquairum includes a Maintenance Kit and step-by-step video tutorials accessible through the Membership Portal, allowing customers to set up their aquarium safely at home without prior experience.

Customers must follow the provided instructions and setup checklist to ensure correct assembly and stable water conditions before introducing livestock.

4.5 Professional Aquarium Setup Service

Professional setup is available for an additional fee through the Living Oceans Team (Perth Metro) and our partner network across Greater Perth, Regional WA, and interstate.
A qualified installer will assemble, test, and prepare the aquarium for livestock delivery in accordance with Living Oceans standards and manufacturer specifications.
Additional charges may apply if the aquarium must be relocated within the premises after delivery.

4.6 Site Requirements and Customer Responsibility

Customers are responsible for ensuring their delivery and installation site meets the pre-installation requirements provided at purchase, including adequate structural support, level flooring, power access, and suitable environmental conditions.
If these requirements are not met, Living Oceans reserves the right to refuse installation, reschedule at the customer’s expense, or adjust the setup process as necessary.
Living Oceans is not liable for performance issues or damage resulting from improper site preparation or installation performed outside our guidelines.
Customers are also responsible for providing clear and safe access for delivery teams, including notifying us of any access restrictions such as stairs or narrow doorways.

4.7 Behaviour and Rescheduling

Customers must treat all Living Oceans staff and contractors with respect and courtesy at all times. Harassment, discrimination, abuse, or unreasonable behaviour will not be tolerated.
Living Oceans reserves the right to reschedule or postpone services if a customer or team member is unwell, or if conditions are unsuitable for safe or proper installation.
In cases of inappropriate conduct, Living Oceans may cancel or withdraw services without refund, and unlawful behaviour may be reported to authorities.

4.8 Risk and Inspection

Risk of loss or damage to the aquarium and its components passes to the customer upon delivery. For livestock, risk transfers upon acceptance of delivery.
Customers should inspect all deliveries promptly and report any issues to support@livingoceans.com.au within 24 hours of receipt.

4.9 Insurance and Liability During Transit

Optional shipping insurance may be requested at the time of purchase. If declined, Living Oceans is not liable for loss or damage occurring after handover to the carrier, beyond the standard coverage offered by the courier service.

5. Maintenance and Support

This section outlines the maintenance options, support services, and customer responsibilities associated with the Living Oceans Aquarium.

5.1 Self-Maintenance

Each aquarium includes a Maintenance Kit and step-by-step video tutorials accessible through the Living Oceans Support Hub. These resources guide customers through safe water changes and testing every three months, as well as ongoing maintenance routines.
Regular three-month water changes help maintain system stability, replenish trace elements, and support nutrient balance for healthy corals and fish.

5.2 Professional Maintenance

Professional maintenance services are available through the Living Oceans Team in Perth Metro and our partner network across Greater Perth, regional Western Australia, and interstate.

Services include:

  • Quarterly Maintenance & Care Subscription – includes professional water testing, seawater changes, and system health checks.
  • One-off Maintenance Visit – a single professional service including a full water change and system check.

5.3 Customer Responsibilities

Customers who choose self-maintenance are responsible for following the Care Guidelines and video instructions provided by Living Oceans.
Failure to perform maintenance as recommended may affect livestock health, system performance, and eligibility for warranty coverage.

5.4 Service Scheduling and Rescheduling

Maintenance services are scheduled by appointment and subject to regional availability.
Living Oceans reserves the right to reschedule or postpone services in the event of illness, unsafe conditions, or factors affecting travel or access.
Customers may also reschedule appointments with reasonable notice, as outlined in their service confirmation email.

5.5 Behaviour and Conduct

All customers must treat Living Oceans staff and contractors with respect and courtesy at all times. Harassment, discrimination, abuse, or unreasonable behaviour will not be tolerated.
Living Oceans reserves the right to cancel or withdraw services without refund in such circumstances, and any unlawful conduct may be reported to authorities.

6. Membership and Exclusive Access

Every Living Oceans Aquarium purchase includes complimentary membership with access to exclusive resources, training, and support through the Living Oceans Membership Portal. Membership helps customers confidently care for their aquarium, access professional services, and manage their system long-term.

6.1 Membership Inclusions

Membership provides access to:

  • Step-by-step video tutorials for aquarium setup, water changes, and ongoing care
  • A complimentary online consultation after purchase to select and upgrade fish, corals, and optional services
  • Ongoing training, care guidelines, and technical support through the Membership Portal
  • Access to maintenance subscriptions, bookings, and special member offers

6.2 Account Management

Members are responsible for keeping their login details secure and ensuring all contact information remains accurate and up to date.

Any unauthorised access or suspected misuse of a membership account must be reported immediately to support@livingoceans.com.au

6.3 Non-Transferable Membership

Membership is provided exclusively to the original purchaser of the Living Oceans Aquarium and is non-transferable.
Access is linked to the aquarium’s serial number and remains valid for the duration of ownership.

6.4 Termination or Suspension

Living Oceans reserves the right to suspend or terminate membership in cases of misuse, fraudulent activity, or breach of these Terms and Conditions.
Membership benefits may also be adjusted with reasonable notice if program updates or service changes occur.

6.5 Changes to Membership Benefits

  • We may periodically update membership resources, or pricing for member-related services.
  • Any material changes will be communicated through the Membership Portal or by email.
  • Continued use of membership benefits after notification constitutes acceptance of the updated terms.

7. Warranties

We provide warranties to ensure the quality and reliability of the Living Ecosystem Aquarium and its components. These warranties are offered in addition to your rights under Australian Consumer Law (ACL). By purchasing from our website, you agree to the following terms regarding warranties.

Note: Customers must adhere to the Care Guidelines (defined in Section 5.4) to maintain warranty coverage.

7.1 General Warranty Coverage

  • All products sold by us are guaranteed to be free from defects in materials and workmanship at the time of delivery.

  • This warranty is valid only for the original purchaser and does not extend to third parties or subsequent owners.

7.2 Equipment Warranty

  • All equipment, including filtration systems, pumps, and heaters, is covered by a 12-month Equipment Warranty.

  • Under this warranty, we will repair or replace faulty equipment at no additional cost to the customer.

  • Claims under the Equipment Warranty must be submitted within 12 months from the date of delivery and are subject to verification by us.

7.3 Livestock Warranty

  • All livestock, including fish and corals, come with a 24-hours Livestock Warranty.

  • This warranty covers replacement or a store-credit guarantee if the livestock is deemed to be in substandard health or condition within 24-hours of delivery.

  • Claims must be made within the warranty period, and customers are required to demonstrate adherence to the Care Guidelines.

  • Failure to adhere to the Care Guidelines, improper handling, or neglect may void the Livestock Warranty.

7.5 Warranty Claims Process

  • To make a warranty claim, customers must email at support@livingoceans.com.au.

  • Customers may be required to provide proof of purchase, photographs of the issue, and other relevant details for claim evaluation.

  • Approved claims will be resolved through repair, replacement, or restoration of the affected item, as determined by us.

7.6 Exclusions

Warranties do not cover:
a. Damage caused by misuse, neglect, or failure to follow the Care Guidelines.
b. Normal wear and tear or aesthetic imperfections that do not affect functionality.
c. Loss or damage resulting from environmental factors beyond our control, such as power surges or natural disasters.
d. Failure to adhere to the stocking limits and specifications for the aquarium as defined at the time of purchase. Overloading the aquarium or introducing incompatible species may void the warranty.
e. Livestock loss caused by aggression, territorial behaviour, or incompatibility between fish or other livestock.
f. Livestock loss occurring after conducting a professional maintenance visit.

7.7 Rights Under Australian Consumer Law (ACL)

  • The warranties provided by us are in addition to your statutory rights under the ACL.

  • Customers are entitled to a repair, replacement, or refund if a product fails to meet the guarantees outlined in the ACL.

8. Returns, Refunds, and Replacements

We are committed to providing quality products and ensuring customer satisfaction. This section outlines the terms for returns, refunds, and replacements in compliance with Australian Consumer Law (ACL).

8.1 Eligibility for Returns

  • Products may be returned if they are defective, damaged, or not as described at the time of delivery.

  • Live livestock, including fish and corals, are not eligible for returns due to their perishable nature, unless they fall under the Livestock Warranty (see Section 7.3).

8.2 30 Day Money Back Guarantee

  • Living Oceans offers a 30 Day Money Back Guarantee on eligible Living Oceans Aquarium purchases to support customer confidence and satisfaction.

    Customers may request a return and refund within 30 days of equipment delivery, subject to the following conditions:

    a. The 30 Day Money Back Guarantee applies only to the purchase of a complete Living Oceans Aquarium bundle sold by Living Oceans as an all-inclusive system package. The guarantee does not apply to individual livestock, equipment, accessories, add-ons, maintenance services, subscription services, custom upgrades, or standalone purchases.

    b. To be eligible for the guarantee, the complete Living Oceans Aquarium bundle, including all equipment, livestock, accessories, and supplied components, must be returned to Living Oceans.

    c. Customers must follow all setup instructions, Care Guidelines, and mandatory training requirements provided by Living Oceans during the 30 day guarantee period.

    d. The aquarium and supplied components must not show signs of misuse, neglect, intentional damage, unauthorised modifications, or failure to follow Living Oceans guidelines.

    e. Where a return is approved under this 30 Day Money Back Guarantee, Living Oceans will arrange collection and return transport of the complete Living Oceans Aquarium bundle, including livestock and supplied components.

    f. Refund requests must be submitted in writing to support@livingoceans.com.au within the 30 day guarantee period.

    g. Approved refunds will be processed to the original payment method within 14 business days following inspection and approval of the returned Living Oceans Aquarium bundle.

    h. Outside the 30 day guarantee period, Living Oceans does not accept returns or provide refunds for change of mind, except where required under Australian Consumer Law.

    i. This guarantee operates in addition to, and does not limit, any rights available under Australian Consumer Law.

8.3 Refunds

  • Refunds are offered in cases where:
    a. A product is deemed defective or damaged upon delivery and cannot be repaired or replaced.
    b. A claim under Australian Consumer Law requires a refund to be provided.

  • Approved refunds will be processed to the original payment method within 14 business days of claim approval.

8.4 Replacements

  • Where eligible, defective or damaged products will be replaced with an identical or equivalent product at no additional cost to the customer.

  • Replacement claims for livestock will be handled in accordance with the Livestock Warranty (see Section 7.3).

8.5 Return Process

  • Customers must contact us via the Membership Portal or email at support@livingoceans.com.au to initiate a return, refund, or replacement request.

  • All claims must include proof of purchase and a description or photographic evidence of the issue.

  • Products approved for return must be securely packaged and shipped to the address provided by us. Customers may be responsible for return shipping costs unless the return is due to a fault on our part.

8.6 Exclusions

Returns, refunds, or replacements will not be provided for:
a. Damage caused by misuse, neglect, or failure to follow the Care Guidelines.
b. Normal wear and tear or aesthetic imperfections that do not affect functionality.
c. Live livestock purchased from suppliers other than us.

8.7 Australian Consumer Law (ACL)

  • This Returns, Refunds, and Replacements Policy operates in addition to your rights under the ACL.

  • Customers are entitled to a repair, replacement, or refund if products fail to meet guarantees under the ACL, such as if they are not of acceptable quality, not fit for purpose, or do not match their description.

9. Limitation of Liability

We aim to provide high-quality products and services; however, to the extent permitted by law, we limit our liability as follows:

9.1 Exclusions of Liability

We will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from:
a. The use or inability to use our products or services.
b. Failure to adhere to the Care Guidelines.
c. Delays in delivery or installation due to circumstances beyond our control.

9.2 Liability for Products

Our liability for defective products is limited to repair, replacement, or refund as outlined in these Terms and Conditions and in compliance with Australian Consumer Law (ACL).

9.3 Customer Responsibilities

  • Customers are responsible for ensuring their aquarium and its components are used and maintained in accordance with the Care Guidelines.

  • We assume no liability for:
    a. Damage resulting from modifications or alterations to the aquarium or its components not authorised by us.
    b. Loss or damage caused by the use of livestock, equipment, or materials not supplied by us.
    c. Issues arising from overstocking, improper maintenance, or neglect of the ecosystem.

9.4 Force Majeure

We will not be held liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions, or government regulations.

9.5 Statutory Rights

Nothing in these Terms and Conditions excludes, restricts, or modifies rights guaranteed under Australian Consumer Law (ACL), including your rights to a remedy if a product is defective or not fit for purpose.

10. Indemnification

By using our products and services, you agree to indemnify and hold harmless us, our directors, officers, employees, affiliates, agents, contractors, suppliers, and licensors from and against any claims, demands, liabilities, damages, losses, costs, or expenses, including reasonable legal fees, arising out of or related to:

10.1 Breach of Terms

  • Your breach of these Terms and Conditions or the warranties and representations outlined herein.

10.2 Improper Use

  • Your misuse, neglect, or failure to adhere to the Care Guidelines when using the Living Ecosystem Aquarium or related products.

10.3 Unauthorised Modifications

  • Any unauthorised modifications or alterations made to the Living Ecosystem Aquarium or its components, including the introduction of livestock or materials not supplied by us.

10.4 Third-Party Actions

  • Claims resulting from your actions or interactions with third parties, including any use of our products contrary to these Terms and Conditions or applicable laws.

10.5 Violation of Law

  • Your violation of any laws, regulations, or rights of a third party in connection with your use of our products or services.

11. Intellectual Property

We respect and protect our intellectual property rights. By accessing or using our website, products, or services, you agree to the following terms regarding intellectual property:

11.1 Ownership

  • All content on our website, including but not limited to text, images, graphics, logos, videos, and software, is our property or the property of our licensors and is protected under Australian copyright, trademark, and intellectual property laws.

11.2 Restrictions on Use

  • You may not reproduce, copy, distribute, display, sell, or otherwise exploit any content from our website, products, or services without prior written permission from us.

  • Unauthorised use of our intellectual property, including reverse engineering or modifying our products, is strictly prohibited.

11.3 Trademarks

12.3 Non-Exclusion of Statutory Rights

  • Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any rights guaranteed under Australian Consumer Law (ACL).

13. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time to reflect updates to our business practices, policies, or changes in applicable laws.

13.1 Notification of Changes
